# Terms of Service

These terms are the agreement between you and Rustichello ("we", "us") when you use the
Rustichello website and app. By using the service you accept them. If you do not accept
them, please do not use the service.

The operator of record and its registered address are stated on our contact page.

## 1. What the service does

Rustichello plans a day out from a few details you give us, and turns photographs from a
trip into a written photographic memoir. Planning is free. Building a memoir may be paid;
the price shown at the time you buy is the price that applies.

## 2. Your account

An account is optional. If you create one, keep your password to yourself and tell us at
once if you think someone else has it. You are responsible for what happens under your
account. You must be 16 or older to create one.

## 3. Your content stays yours

Photographs, clips and text you upload remain yours. You grant us a worldwide,
royalty-free, non-exclusive licence to store and process that content **solely** to
provide the service to you — to build your itinerary and memoir, to host the memoir at
the link we give you, and to send it to you if you ask. That licence ends when you delete
the content. We do not use your content to advertise, do not sell it, and do not use it
to train AI models.

You promise that you have the right to upload what you upload, that it does not infringe
anyone else's rights, and that it is not unlawful. In a group memoir you are responsible
for having the agreement of the people whose photographs you pool.

## 4. Acceptable use

Do not use the service to upload unlawful, abusive or infringing material; to
impersonate anyone; to attempt to break, overload, scrape or reverse-engineer it; to
circumvent rate limits or spending caps; or to resell access. We may suspend or end
access that breaks these rules.

## 5. Sharing a memoir

A memoir link is a long, unguessable address, not a password-protected page. Anyone you
give the link to can open it, and can pass it on. Share it only with people you are happy
to see it, and delete the memoir when you are finished sharing.

## 6. Accuracy — read this before you rely on a plan

Itineraries are suggestions generated automatically, partly by an AI model. Opening
hours, prices, travel times, accessibility and safety information may be wrong or out of
date. **Check anything that matters with the venue or an official source before you rely
on it.** We are not liable for travel decisions you make on the basis of a generated
plan. Nothing here is professional travel, medical, or safety advice.

## 7. Payment, refunds and cancellation

Where a memoir is paid, payment is taken by Stripe; we never see your card number. If a
memoir fails to build after payment, tell us and we will rebuild it or refund it. If you
are a consumer in the UK or EU you have the usual statutory cancellation rights; by
asking us to build a memoir immediately you agree that the work begins at once, which may
reduce your right to cancel once it is delivered. Nothing in these terms affects your
statutory rights.

Any subscription runs until you cancel; cancelling stops future charges and takes effect
at the end of the paid period.

## 8. Availability

The service is provided "as is" and "as available". We may change, suspend or withdraw
features, and we do not promise uninterrupted service. Generation depends on third-party
providers and can degrade to an offline generator, or be rate-limited, without notice.

## 9. Liability

Nothing in these terms limits liability for death or personal injury caused by
negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, loss of profit,
loss of data, or losses arising from travel decisions; and our total liability to you for
all claims in any 12-month period is limited to the greater of the amount you paid us in
that period, or £50.

Keep your own copies of photographs you care about. A memoir is a rendering, not a backup.

## 10. Ending the agreement

You can stop using the service, and delete your account and data, at any time — see the
"Your rights" section of the Privacy Policy. We may end or suspend access if you
seriously or repeatedly break these terms.

## 11. Privacy

How we handle personal data is set out in the Privacy Policy, which forms part of these
terms.

## 12. Changes to these terms

We may update these terms. The date at the top changes when we do, and material changes
are announced in the app before they take effect. Continuing to use the service after
that means you accept the new terms.

## 13. Law and disputes

These terms are governed by the laws of England and Wales, and the courts of England and
Wales have exclusive jurisdiction — except that if you are a consumer resident elsewhere
in the UK or EU, you keep the protection of your local mandatory consumer law and may
bring proceedings in your local courts.
